BERGER Peel and Win Christmas Promotion Rules

  • Entrants must be at least 18 years of age at the time of entry.
  • Employees, directors (and their parents, siblings, spouses and children) of BERGER PAINTS and their respective advertising agencies and participating hardware stores are not eligible to participate in the Promotion.

How to Enter

  • Shoppers will receive a "Peel & Win" ticket for every 2 gallons of eligible BERGER PAINTS purchased in participating hardware stores. Eligible products are Royale Emulsions, Weatherproof, 303, Everglow, 404, Rust Pro, Magicote Flat and Magicote Gloss, whether the purchase is in quarts, one gallon or 5-gallon pails.
  • To enter for a chance to win the fortnightly or grand prize, entrants are required to:
    • a. Visit www.bergerpaintscaribbean and enter the alphanumeric code from the peel & win ticket with their contact information.
    • b. Entrants can also enter for the fortnightly or grand prize by sending a text message to the number 136 on the Digicel network with the alphanumeric code from the peel & win ticket. Local SMS rates will apply.
  • Winners must present proof of purchase and the winning peel and win ticket to claim prizes. The promotion runs from November 1st, 2016 until 12:00 AM EST December 31st, 2016.

    BERGER PAINTS is not responsible for late, incomplete, misdirected entries or printing errors. All entries received from ineligible entrants will be void. All entries become the property of the BERGER PAINTS.

The Prizes

  • All peel & win tickets will provide a prize, while stocks last.
  • Peel and Win ticket prizes are stylus pens, caps, tote bags, drawstring bags, car chargers, LED keyring, sun shades, 10% discount off up to 5 gallons of paint and 25% discount off up to 5 gallons of paint.
  • Winners of stylus pens, caps, tote bags, drawstring bags, car chargers, LED keyring and sun shades will instantly receive their prizes at the store where they purchased the BERGER PAINT products. Winners of the 10% discount and 25% discount have from January 1st 2017 to March 31st 2017 to redeem their discount, these discounts cannot be combined with any other BERGER PAINT discount.
  • The fortnightly prizes are four 7-inch Samsung Galaxy Tablet. There will be four fortnightly winners for the duration of the promotion. The Grand Prize is a round trip in economy class on any airline at any time of the year to Miami, Florida. The prize will be valid for one year as of the day of the draw. A maximum value of US$350 will be paid for airfare for each of the two persons for a combined value of US$700. The Grand Prize winner will be provided with US$150 each for accommodation for a combined value of US$300 (for a stay not exceeding two days). Winners will be responsible for sourcing their own accommodation. Winners of the grand prize will be solely responsible for all and any other related travel expenses. In case the winner cannot travel during the validity of the prize and/or cannot qualify for the necessary travel documentation, the prize will be voided. The winner will be responsible for any taxes, tips, insurance and expenses not explicitly stated as part of the prize. The Grand Prize winner will also be given US$1,000 in spending money.
  • The Fortnightly and Grand Prize will be will be drawn randomly at BERGER PAINTS office at 264 Spanish Town Road.
    • a. The schedule for the fortnightly prize draws are November 15 and 29, 2016 and December 13 and 28, 2016.
    • b. The Grand Prize draw will be conducted on January 4, 2017.
  • There will be four fortnightly winners and one Grand Prize winner.
  • All entries from the website and via SMS will be combined and the fortnightly and Grand Prize winner will be selected by an automated electronic random draw to be completed by a representative from BERGER PAINTS at the company’s head offices.
  • The winners will be notified by telephone within five days from the date of the draw. Three additional backup winners will be chosen. Contact will be attempted by telephone. If the winner cannot be contacted by telephone within five days of the draw date, another winner will be selected from the backup winners (in the order the winners were selected).
  • BERGER PAINTS and or its representatives reserve the right to examine identification and may choose to accept or deny awarding the prize based on the information presented.
  • The Winners will be required to provide proof of their age and sign an Affidavit of Eligibility/Prize Acceptance and Release within five days of the notification to be confirmed as the winner. A Passport, Driver’s License, National ID will be the accepted forms of identification. If the winner declines to fulfil these conditions to collect the prize, their eligibility will be voided and another winner will be chosen from the pool of backup winners. The winners and their companions must be legally and physically able to travel, and must be able to qualify for the necessary travel documentation (passport, US travel visa, etc.). If the selected winner is unable to meet any of these criteria by the time the validity of the prize expires, their eligibility will be voided.
  • If a Winner does not redeem the prize in the manner described above, BERGER PAINTS reserves the right, in its sole and absolute discretion, to disqualify such winner and to select a replacement winner from the remaining qualifying entrants. BERGER PAINTS shall not be responsible for failed attempts to redeem a prize and no responsibility is assumed by BERGER PAINTS for any problem(s) associated with attempt(s) to redeem a prize(s).
  • Prizes cannot be transferred, assigned, or redeemed for cash. Unless otherwise set forth herein, winners of the weekly and grand prizes shall be solely responsible for any and all costs not specifically described as part of the prize. Winners of the grand prize will be solely responsible for all and any other related travel expenses and accommodations, except for the airfare.
  • BERGER PAINTS is not responsible for any liabilities arising directly or indirectly from the award or use of the prizes.
  • In claiming your prize, you acknowledge that BERGER PAINTS reserves the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner, across any advertising medium and for promotional purposes and without financial remuneration.

Privacy / Use of Personal Information

BERGER PAINTS may gather Personal Information provided by entrants for the purposes of conducting and managing this contest and may, for this purpose, disclose such Personal Information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as may be required by regulatory authorities. Personal Information may include, but is not limited to: name (full name or first initial and last name), maiden name, email address, telephone number and physical address. This information is only collected when volunteered by an individual entering the contest. If the requested Personal Information is not provided, then an individual will not be able to participate in the contest. Each entrant gives permission to BERGER PAINTS to send promotional messages to them.

Claims

Under no circumstances will entrants be permitted to seek the award of damages, and hereby waives all rights to claim, punitive, incidental and consequential damages or any other damages, and to have damages multiplied or otherwise increased. All entrants agree to submit to the exclusive jurisdiction of the BERGER PAINTS location governing their jurisdiction and agree to waive the right to a jury trial with respect to any claim or dispute with regard to any aspect of this promotion or official promotion rules.
