THIS CHRISTMAS GO BOLD WITH BERGER Promotion Rules

1. The name of the promotion is “Berger Shoppa Showdown”. Entrants must be at least 18 years of age at the time of entry.
2. Employees, directors of BERGER PAINTS, The Lab, other advertising agencies as well as their immediate families (their parents, siblings, spouse and children) and participating hardware stores are not eligible to participate in the promotion.
3. Participants are allowed to enter as many times as they wish to increase their chances of winning, however, only one prize will be awarded per person in the fortnightly (bi-weekly) draw. Each code can only be used once and any attempts thereafter with the same code will be void.
4. Non-cash discounts or prizes cannot be redeemed for cash or transferred to anyone.
5. The winner must present a valid I.D. when redeeming his or her prizes. The only valid I.D’s that will be accepted are voter’s I.D, Passport or Driver’s License.
6. Prizes cannot be transferred, assigned, or redeemed for cash. Unless otherwise set forth herein, winners of the fortnightly (bi-weekly) prizes shall be solely responsible for any and all costs not specifically described as part of the prize.
7. Each entrant may only receive a maximum of 10 coupons per receipt, despite the volume purchased.

How to Enter

1. Shoppers will receive a coupon with a code to enter for every two (2) gallons of eligible Berger Paints purchased in participating hardware stores. Eligible products are Berger Everglow, Berger Weatherproof Ultra, Berger Royale Gloss, Berger Royale Semi-gloss, Berger 303, Berger 404 gloss, Berger 404 flat, Berger 404 semi-gloss and Berger Rust Pro whether the purchase is in quarts, one gallon or 5-gallon pails.
2. To enter for a chance to win the fortnightly (bi- weekly) prizes, entrants are required to:
   1. Visit the website http://www.bergerpaintscaribbean.com/barbados/get-inspired and enter the code provided from the text code ticket with their contact information (name, email address and telephone number). The entrant’s name and telephone number are mandatory however the email address is not.
3. All entrants must retain their receipts (proof of purchase) and coupon received for collection of prizes.
4. The Promotion is valid from July 5, 2021 until 11:59 PM EST August 14, 2021. BERGER PAINTS is not responsible for late, incomplete, misdirected entries or printing errors. All entries received from ineligible entrants will be voided. All entries become the property of Berger Paints.
5. Each code can only be used once and all subsequent entry submission with the same code will be voided.

The Prizes

Overview:

Berger Paints Barbados Limited will execute the “Berger Shoppa Showdown” Promotion in participating hardware stores island wide and all Colour Shop locations. Entrants will have an opportunity to win fortnightly (bi-weekly) prizes of supermarket vouchers valued at $250BBD each.

There will be a total of 8 prize winners, broken down as follows:

PRIZES

✓ A total of two (2) persons will win the fortnightly prises of the supermarket voucher valued at $250BBD each:

• Two persons will be randomly selected for the fortnightly (bi-weekly) prize based on the specific entry periods (6 weeks, 2 draws).

✓ Two (2) grand Prize Winners and (2) consolation prize winners:

• Two persons will be randomly selected to compete in a shopping spree running from aisle to aisle (within 60 seconds) in a hardware store picking up items to a maximum value of $2,500 BBD.
• The person that gets to the cash register first within 60 seconds will be awarded the winner and will get the items in their trolley valued at maximum $2,500 BBD.
• The person who loses the Shoppa Showdown will be awarded a supermarket voucher valued at $500 BBD.
• There will be a total of two shopping sprees whereby there will be two winners and two consolation prize winners.

SELECTION OF WINNERS and REDEMPTION OF WINNERS

1. Potential winning entries will be generated using the campaigns database system from bergerpaintscaribbean.com. Entries will be randomly selected from the database containing the phone numbers, entry codes and dates of entry from which the text was submitted. The draw will be done by 1 p.m. on each of the draw dates listed.
2. For each draw date, after the first draw, only entries entered between the day of the previous draw date at 12:00 a.m. and the day before that draw date at 11:59 p.m. will be eligible to win. All entries entered during the promotional period will be eligible to win the grand prize.
3. Two (2) entrants fortnightly (bi-weekly) will be electronically selected at random on each draw date as per schedule provided from the database. These winners will each win one (1) of the fortnightly (bi-weekly) prizes. An additional three (3) entries will then be selected to function as backup winners. The draws are as follows:
   1. 1^st Bi-weekly draw qualify entries text or entered on the Berger website between July 5th to July 18th, 2021. The draw date is Tuesday July 20, 2021.
   2. 2^nd Bi-weekly draw entries text or entered on the Berger website between July 19th to August 1st, 2021. The draw date is Tuesday August 3, 2021.
4. The grand Prize draw date is August 17, 2021 whereby a total of four (4) persons will be selected to participate in the two shopping sprees.
5. There will be six (6) total winners for this promotion, two bi-weekly, two (2) grand prize winners and two (2) consolation prize winners.
6. The winners will be notified by telephone within three days from the date of the draw. Three additional backup winners will be chosen. Contact will be attempted by telephone two times a day for the three day period. If the winner cannot be contacted by telephone within three days of the draw date, another winner will be selected from the backup winners (in the order the winners were selected). In the event that no winner can be found or a prize remains unclaimed after two (2) months, Berger Paints reserves the right to retain possession of the prizes.
7. BERGER PAINTS and or its representative reserve the right to examine identification and may choose to accept or deny awarding the prize based on the information presented.
8. The Winners will be required to provide proof of their age and sign an Affidavit of Eligibility/Prize Acceptance and Release within five days of the notification to be confirmed as the winner. A Passport, Driver’s Licence or National ID will be the accepted forms of identification. If the winner declines to fulfil these conditions to collect the prize, their eligibility will be voided and another winner will be chosen from the pool of backup winners. If the selected winner is unable to meet any of these criteria by the time the validity of the prize expires, their eligibility will be voided.
9. If a winner does not redeem the prize in the manner described above, BERGER PAINTS reserves the right in its sole and absolute discretion, to disqualify such winner and to select a replacement winner for the remaining qualifying preselected backup entrants. BERGER PAINTS shall not be responsible for failed attempts to redeem a prize and no responsibility is assumed by BERGER PAINTS for any problem (s) associated with attempt (s) to redeem prize (s). BERGER PAINTS is not responsible for any liabilities arising directly or indirectly from the award or use of the prizes.
10. In claiming your prize, you acknowledge that BERGER PAINTS reserves the right to publicize your name, character, likeness, photograph, voice and the fact that you are the winner, across any advertising medium and for promotional purposes and without financial remuneration.
11. Privacy / Use of Personal Information: BERGER PAINTS may gather Personal Information provided by entrants for the purposes of conducting and managing this contest and may, for this purpose, disclose such Personal Information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as may be required by regulatory authorities. Personal Information may include, but is not limited to: name (full name or first initial and last name), maiden name, email address, telephone number and physical address. This information is only collected when volunteered by an individual entering the contest. If the requested Personal Information is not provided, then an individual will not be able to participate in the contest. Each entrant gives permission to BERGER PAINTS to send promotional messages to them.
12. Claims: Under no circumstances will entrants be permitted to seek the award of damages, and hereby waives all rights to claim, punitive, incidental and consequential damages or any other damages, and to have damages multiplied or otherwise increased. All entrants agree to submit to the exclusive jurisdiction of the BERGER PAINTS location governing their jurisdiction and agree to waive the right to a jury trial with respect to any claim or dispute with regards to any aspect of this promotion or official promotion rules.
